For 23 years, the Law Center to Prevent Gun Violence has resolutely advocated for the smart gun laws that save lives. In 2016, our work became even more challenging and necessary, with the election of a president who was supported by the gun lobby to the tune of $30 million. But our experienced, committed team of experts is at the ready, fighting each day to defeat the gun lobby’s deadly agenda that puts profits before people.

And our efforts to check the gun lobby’s outsized influence were amplified by a new, exciting venture with our partners at Americans for Responsible Solutions, led by former Congresswoman Gabrielle Giffords and her husband, former NASA astronaut and Navy combat veteran Captain Mark Kelly. We’re forming a new force for gun safety legislation, education, research, and advocacy that stretches from coast to coast, and we couldn’t be more thrilled to forge ahead in the fight against gun violence.

This year, our work was as relevant as ever, as our nation mourned the deadliest mass shooting in modern American history—an act of hate that left 49 dead and 58 wounded at the Pulse nightclub in Orlando, Florida. In the wake of this unspeakable tragedy, our legal experts were at the ready, providing their unparalleled expertise to lawmakers who wanted to take action against tragedies like this one. Our perspective on the commonsense solutions to gun violence is priceless in those moments of darkness, and we couldn’t be more proud of the powerful impact we’ve had.

Over the years, our unique expertise has put us at the forefront of the fight for gun safety. We’re the most trusted and relied-upon source for information about gun laws in the United States and the proven solutions that will help us shore up public safety in our communities and save precious lives from this public health crisis that takes more than 90 American lives each day.

We know none of this lifesaving work would be possible without the essential support that our donors, members, partners, and friends provide, whom we are so thrilled to acknowledge in our 2016 Annual Report. 2016 Highlights

Making Advancements in the Fight Against Gun Violence

As the leading experts on United States gun policy, we’re fueling the fight for smart gun laws in three essential areas: legislation, litigation, and education. This year, our staff tracked 1,472 proposed gun bills across all 50 states. And in that analysis, we’ve counted 160 new smart gun laws passed in 42 states and Washington, DC since the tragedy at Sandy Hook. Public support for these policies continues to grow—over 90% of Americans want their lawmakers to pass legislation like universal background checks on every gun purchase.

Another essential aspect of the work we do at the Law Center is to stand up to frivolous lawsuits brought by the gun lobby to undermine smart gun laws already on the books. This work is both rewarding and extraordinarily successful—since the landmark Heller decision in 2008, our movement has defeated the vast majority of these lawsuits in the lower courts. The Supreme Court still declines to hear new gun rights cases each year, too. Our overwhelmingly victorious work in this area proves that gun safety laws do not stand at odds with the Constitution, and that smart, reasonable firearms regulation is absolutely fundamental to the Second Amendment.

Our legal experts have an unrivaled perspective on every aspect of the potential smart gun laws have to save lives, and how they can serve to improve public safety. So much of our work involves educating as many lawmakers, community activists, and the public as possible on the findings of our analysis. Through a collaborative approach, we reach policymakers and advocates to work with the community to reduce shootings, and our powerful library of publications and policy guides promotes the Law Center’s broad base of knowledge on the solutions to the gun violence.

Our legal experts have an unrivaled insight into every aspect of the lifesaving impact smart gun laws have on public safety, and much of our work involves educating as many lawmakers, civic leaders, and citizens as possible on our findings. Through our collaborations with policymakers and advocates, our educational programs, and our robust library of publications and policy guides, the Law Center shares and promotes our thoroughly researched solutions to the gun violence crisis. Our work helps both the public and our leaders make informed decisions about a complex and entrenched issue that affects far too many Americans each year.

We’re proud to have worked to meet so many powerful milestones in 2016.

Legislation

The Law Center was proud to team up with Lt. Governor Gavin Newsom to draft and advocate for the “Safety for All” initiative—California’s Proposition 63, a package of commonsense gun reforms that further strengthened our home state’s gun laws by prohibiting possession of large capacity ammunition magazines, requiring background checks for ammunition sales, providing a relinquishment process for convicted of serious and violent crimes, requiring the reporting of lost and stolen guns, and mandating that records be shared with the FBI for background checks. The initiative passed with an overwhelming 63% of the vote.

This year, Washington State voters overwhelmingly approved an Extreme Risk Protective Order measure. This new law, which used the Law Center’s GVRO model law as a guide, is a lifesaving tool that law enforcement can use to disarm people who are a danger to themselves or others. A similar law went into effect in California in 2016 as well.

Additionally, six states enacted laws to keep guns out of the hands of domestic abusers and three states improved laws that keep the dangerously mentally ill from accessing firearms. Delaware closed a gap in the federal background check law, extending the maximum background check processing time from 3 to 25 days to allow for in-depth investigations.

Litigation

One of the ways the Law Center takes action against the epidemic of gun violence in the United States is to stand up to the gun lobby’s frivolous lawsuits by defending lifesaving smart gun laws that have already been enacted. We achieve victories in this area at a remarkable rate, proving time and again that the Second Amendment is not a barrier to saving lives with smart gun laws. Our attorneys’ research, coupled with our pro bono network, enables local leaders to legislate for public safety and stand up to the gun lobby’s fallacious lawsuits that inevitably follow.

Despite every effort from the gun lobby to prove otherwise, we continue to prove that smart gun laws are constitutional. In fact, 94% of Second Amendment challenges have been defeated since the landmark 2008 ruling in Heller v. District of Columbia. In 2016, we filed 6 amicus briefs in critical Second Amendment cases, and assisted numerous city and state’s attorneys facing challenges to gun laws that enjoy broad public support and save lives.

One of our most critical victories in 2016 was in the case Peruta v. San Diego, in which the Ninth Circuit Court of Appeals found California’s regulations on who can carry a concealed weapon in public are constitutional. The Law Center has been deeply involved with the case from the very start, filing several amicus briefs throughout the litigation process.

We also launched a new impact litigation project, the Firearms Accountability Counsel Taskforce, or FACT. The new taskforce will be devoted to pursuing legal strategies to address America’s dire gun violence crisis and hold the gun industry responsible for unfair business practices that endanger public safety.

Education

Our staff of attorneys have an unrivaled expertise in understanding every aspect of gun violence prevention, from the laws that legislators can and should enact, to the community-based solutions reducing violence in our streets. It is our mission to share that knowledge with as many leaders, activists, and citizens as possible. Our publications, educational events, and relationships with lawmakers, advocates, and civic leaders help spread accurate, data-driven information about the American gun violence epidemic and solutions to this public health crisis.

In 2016, we hosted our annual Second Amendment conference in Washington DC, with more than 40 litigators, advocates, and public health experts from around the nation in attendance. Participants discussed critical, timely topics in Second Amendment jurisprudence, current research being done to reduce gun violence in the United States, and updates from political and public safety experts on different types of legislation.

We also continued to publish State Gun Law Trendwatch, a bi-weekly analysis and roundup of the latest news in state firearm legislation, which we distribute to our partners in the movement, the media, and the public as a way to keep everyone apprised of the action in statehouses across the country.

We also published another installment of the annual Gun Law State Scorecard. Each year, we grade the states based on how strong their gun laws are. In 2016, 27 states received an F on the Scorecard, and our analysis showed that Mississippi had the weakest gun laws in the nation. California continues to lead the United States when it comes to enacting groundbreaking solutions to the gun violence crisis, followed by Connecticut and New Jersey. Our research also reveals an ongoing correlation between the strength of a state’s gun laws and its gun death rate.

 


Since 2008, our movement has defeated a staggering 94% of Second Amendment challenges.


23rd Anniversary Dinner

Remembering our Founders, Recommitting to our Future

22nd Anniversary Dinner

Each summer, the Law Center’s community of supporters and friends gather to acknowledge the anniversary of our organization’s founding after the 1993 assault weapon massacre at the San Francisco law firm Pettit & Martin. The Anniversary Dinner honors the eight killed and six wounded in that unspeakable tragedy, as well as the 117,000 individuals who become victims of gun violence each year in the United States. We also celebrate our achievements, as an organization and a movement, and presents awards to the people and organizations making a profound impact in this critical space.

In 2016, we celebrated our 23rd Anniversary Dinner at the Westin St. Francis in San Francisco, with more than 450 supporters in attendance. We chose to honor DeVone Boggan with our Distinguished Service Award, for his work Advance Peace, a community-driven, developmental strategy to end urban gun violence. We also presented California Lt. Governor Gavin Newsom with our Courageous Leadership award for his work with the Law Center in advocating for the passage of the groundbreaking package of laws known as Proposition 63.

We also recognized the essential services provided by Keker & Van Nest LLP with the Richard W. Odgers Pro Bono Partner Award for their work defending the city of Pleasant Hill after the gun lobby filed costly lawsuits to challenge a package of smart gun laws the city passed to shore up public safety. Keker also partnered with the Law Center to prepare a highly influential amicus brief in litigation involving Florida’s onerous preemption law, which bars municipal governments from legislating for local public safety.

Our organization is gratified by the generosity of our guests as they displayed their commitment to the Law Center’s work and to this movement to save lives. Standing up for smart gun laws

2015 was a remarkable year for the Law Center and for the movement to save lives from gun violence, and that progress was only possible thanks to the dedication of our members. Our supporters offer us much-needed funding, enabling all the work our attorneys do, from crafting model laws to analyzing legislation to fighting the gun lobby in the courts. Law Center members also help by spreading our message, be it through a call to a legislator, a share on social media, or volunteering at an event. It’s only through collective effort and activism that we can expect to see concrete, lasting change on this issue.

This year, the number of people supporting the Law Center grew significantly, allowing us to hire more staff, launch new programming, and expand our reach to more statehouses across the country.
