Law Center’s Brief: Our brief was filed with the California Supreme Court after the court granted the request of the U.S. Court of Appeals for the Ninth Circuit to decide whether the ordinance was preempted by state law. The brief contends that state law does not expressly or impliedly preempt the local ordinance. The California Supreme Court found that the ordinance was not preempted. The federal claims were ultimately settled with the county’s sales ban ordinance remaining intact.
