Montana has no extreme risk protection order law. In 2025, Montana passed a bill prohibiting local governments from enacting, adopting or implementing their own extreme risk protection order laws or policies.1 A violation of this law is subject to a penalty of up to $10,000, paid by the locality into the state general fund, for each instance.
