K-12 Schools
No person may possess a firearm in a Safe School Zone except individuals with concealed carry licenses who may only possess firearms in their vehicles.1
A Safe School Zone is defined as:
- Any building, structure, athletic field, sports stadium or real property owned, operated, leased or rented by any public or private school including any kindergarten elementary, secondary, or vocational-technical school;
- Any motor vehicle owned, operated, leased, or rented by any public or private school including any kindergarten, elementary, secondary, or vocational-technical school.
A person without a concealed carry permit is not in violation of the law if the firearm is in a locked container or locked firearms rack that is in or on a motor vehicle.2
Colleges and Universities
Beginning January 1, 2025, no person may possess a firearm in a College or University Safe Zone, except individuals with concealed carry licenses who may only possess firearms in their vehicles.3
A College or University Safe Zone is defined as:
- Any building, structure, athletic field, sports stadium or real property owned, operated, leased or rented by any public or private college or university;
- Any motor vehicle owned, operated, leased or rented by any public or private college or university.4
A person without a concealed carry permit is not in violation of the law if the firearm is in a locked container or locked firearms rack that is in or on a motor vehicle.5
Delaware also requires certain institutions of higher learning to publish rules and regulations governing the possession and use of firearms on campus by employees, students and visitors.6
