SCOTUS refuses to grant gun industry unfettered immunity in decision in Mexico case

The justices found that Mexico’s broad claims were not sufficiently supported, but emphasized that gun companies that break the law can be held accountable.

WASHINGTON — Today, GIFFORDS Law Center responded to the Supreme Court of the United States’ decision in Smith & Wesson Brands, Inc. v. Estados Unidos Mexicanos before the United States Supreme Court. GIFFORDS Law Center had filed an amicus brief with other gun violence prevention organizations in the case that can be found here.

“Today’s decision will end Mexico’s lawsuit against the gun industry, but it does not affect our ability and resolve to hold those who break the law accountable,” said David Pucino, Legal Director and Deputy Chief Counsel at GIFFORDS Law Center. “The Justices did not give the gun industry the broad immunity it sought. Instead, they reaffirmed that the victims of gun industry misconduct can hold lawbreakers accountable in court. All survivors, in the United States, in Mexico, and anywhere else, deserve their day in court, and we will continue to support them in their fight for justice.”
