Reject the Nomination of Toby Crouse to Serve on the US District Court of Kansas

Crouse’s record shows extreme views on gun safety 

July 29, 2020 — Giffords, the gun safety organization founded by former Rep. Gabrielle Giffords, warned against voting to support the nomination of Kansas Solicitor General Toby Crouse to serve as a District Judge for the U.S. District of Kansas. When asked by Senate Democrats about his expansive views of the Second Amendment, Toby Crouse claimed that as a judge, he would apply established Supreme Court precedent such as District of Columbia v. Heller without applying his own personal opinions. However, Crouse’s writing in several amicus briefs calling for highly irregular interpretation of the Second Amendment contradict today’s claims.

“During his short tenure as Solicitor General, Toby Crouse made sure the gun lobby knew he was ready, willing and eager to carry their water. Crouse went out of his way to oppose gun safety laws in Kansas and other states and took positions that, if accepted, would make it nearly impossible to regulate dangerous weaponry such as silencers and bump stocks.

“Senate Democrats rightly called out Crouse’s extremist views of the Second Amendment and his efforts to erode gun safety laws. His zeal to promote extreme policies on guns could put all Americans at risk. Toby Crouse’s comments today further underscore that he is unfit for a federal judgeship. The Senate should reject his nomination.”
