GIFFORDS Urges SCOTUS to Fix Reckless Rahimi Decision
Washington DC — Today, GIFFORDS Law Center released the following statement after the US Supreme Court decided to review the Fifth Circuit’s decision in United States v. Rahimi, which struck down the federal law that prohibits people subject to domestic violence restraining orders from possessing guns. Earlier this year, GIFFORDS Law Center, along with a coalition of gun violence prevention and domestic violence prevention groups, filed an amicus brief in support of the Department of Justice’s petition for certiorari.

“A year ago, extremists on the Supreme Court issued the Bruen decision that has resulted in confusion in the courts and led to the Fifth Circuit’s reckless decision in Rahimi. We know that firearms in the hands of individuals who courts have found pose a threat to an intimate partner or child can lead to gun violence. It is common sense to keep guns out of such hands. The Supreme Court must do what is right and clarify that the Constitution does not require us to arm those subject to domestic violence restraining orders with firearms.”
