Ninth Circuit Upholds Majority of Sensitive Places Law in California and Hawaii

WASHINGTON — Today, GIFFORDS Law Center, the legal arm of the gun violence prevention group GIFFORDS, reacted to the Ninth Circuit’s decision to uphold the majority of restrictions on carrying guns in sensitive places in California and Hawaii. The laws were enacted following the US Supreme Court’s decision in New York State Rifle & Pistol Association, Inc. v. Bruen, which disrupted the standards that states like California and Hawaii used to decide who could carry guns in public.


Today’s decision from the Ninth Circuit further illustrates that it is constitutional to keep guns out of sensitive places. At the same time, the decision reflects the chaos the Supreme Court’s Bruen decision has caused. As the Ninth Circuit wrote today, the ‘seemingly arbitrary nature of Second Amendment rulings’ makes it difficult for legislators to respond to the epidemic of gun violence gripping our nation. In the end, we are pleased that the court upheld the majority of these laws, but we will continue to fight for a commonsense approach to fighting gun violence and protecting the Second Amendment,” said Senior Litigation Attorney & Second Amendment Issues Manager Billy Clark.
